2. Scope

This Policy applies to Personal Data collected through:

  • macrotires.ph and any subdomains or microsites we operate;

  • Inquiry, quotation request, and dealer/distributor application forms;

  • Our official Facebook pages (Macro Tires Inc, Deestone Philippines, Comforser Philippines, Radar Tires PH, Roadcruza Tires PH, Marvemax PH, Hawkway PH, and Speedy Tires Inc) and Messenger-based conversations;

  • Email, phone, or in-person communications with our sales and customer service team; and

  • Any other channel through which we collect information for the purposes described below.

This Policy does not apply to the practices of dealers, sub-distributors, or third parties who operate their own independently-controlled websites or pages, even where they sell brands we distribute. We encourage you to review their respective privacy policies.

3. Definitions
  • Personal Data — any information, whether recorded in a material form or not, from which the identity of an individual is apparent or can be reasonably ascertained, directly or indirectly.

  • Sensitive Personal Information — as defined under Section 3(l) of the DPA (e.g., information about an individual's race, health, government-issued ID numbers, or information specifically established by law to be sensitive).

  • Processing — any operation performed on Personal Data, including collection, recording, storage, use, consolidation, blocking, erasure, or destruction.

  • Data Subject — the individual whose Personal Data is processed (you).

  • Personal Information Controller (PIC) — Macro Tires, as the entity that decides why and how your Personal Data is processed.

  • Consent — any freely given, specific, and informed indication of your will, given through written, electronic, or recorded means.

4. Information We Collect

Depending on how you interact with us, we may collect:

a. Information you give us directly

  • Full name, mobile number, email address, and business/delivery address

  • Company name, business permit or DTI/SEC registration details, and TIN (for dealer, distributor, or wholesale account applications)

  • Vehicle type, tire size, and product preferences (for quotation or inquiry requests)

  • Messages, inquiries, and complaints you send via our contact forms, email, phone, or Facebook Messenger

  • Any information you voluntarily provide in surveys, promotions, or feedback forms

b. Information collected automatically

  • Pages visited, time spent on site, referring website, and click activity, collected via cookies and similar technologies (see Section 8)

c. Information from third parties

  • Publicly available business information (e.g., when evaluating a prospective dealer)

  • Information from Meta/Facebook when you message or interact with our Pages, subject to Meta's own privacy policy

We do not knowingly collect payment card numbers through macrotires.ph. If online payment is enabled in the future, payment details will be processed directly by a PCI-DSS-compliant third-party payment processor, not stored on our servers.

5. How We Use Your Information

We process your Personal Data only for legitimate, declared purposes, including to:

  • Respond to product inquiries, quotation requests, and dealer/distributor applications;

  • Process and fulfill orders, deliveries, and after-sales concerns (e.g., warranty claims);

  • Evaluate and onboard prospective dealers or business partners;

  • Send order updates, service advisories, and — where you have consented — marketing communications and promotions;

  • Improve our website, product offering, and customer experience through analytics;

  • Comply with tax, customs, trade, and other legal or regulatory obligations as an importer and distributor; and

  • Protect our legal rights, investigate fraud, and enforce our terms of business.

We will not use your Personal Data for a purpose incompatible with the one disclosed to you at the time of collection, unless we obtain your separate consent or are permitted or required by law.

6. Legal Basis and Consent

We collect and process your Personal Data based on one or more of the following: your consent, the necessity of processing to fulfill a contract or transaction you entered into with us (e.g., a dealer agreement or a purchase), our compliance with a legal obligation, or our legitimate business interests, provided these do not override your fundamental rights.

Where consent is our basis for processing — such as for marketing messages — you may withdraw it at any time, without affecting the lawfulness of processing carried out before withdrawal. Withdrawing consent may limit our ability to respond to certain requests (e.g., we cannot process a dealer application without your business details).

7. Who We Share Your Information With

We do not sell your Personal Data. We may share it, only as necessary, with:

  • Our own sales, logistics, and customer service personnel on a need-to-know basis;

  • Authorized dealers and sub-distributors, where necessary to fulfill your inquiry or transaction in your area;

  • Delivery and logistics providers, to fulfill shipments;

  • Service providers who support our operations, such as web hosting, email/SMS platforms, Facebook Messenger automation, and analytics providers, under confidentiality and data protection obligations;

  • Government or regulatory bodies (e.g., Bureau of Customs, BIR, NPC, or courts), when required by law, regulation, or a valid legal order; and

  • A successor entity, in the event of a merger, acquisition, or sale of business assets, subject to the same privacy commitments described here.

Where any of the above service providers are located outside the Philippines (for example, cloud-hosting or advertising platforms based abroad), we take reasonable steps to ensure your Personal Data receives a comparable level of protection, consistent with NPC guidance on cross-border data transfers.

8. Cookies and Similar Technologies

macrotires.ph may use cookies and similar technologies to:

  • Keep the website functioning properly;

  • Remember your preferences;

  • Understand site traffic and usage patterns (e.g., via Google Analytics or Meta Pixel); and

  • Measure the performance of our advertising and social media campaigns.

You can control or disable cookies through your browser settings. Disabling cookies may affect certain website features. Where we use third-party advertising or analytics cookies, those providers process data under their own privacy policies.

9. Data Storage, Retention, and Disposal

We retain Personal Data only for as long as necessary to fulfill the purposes described in this Policy, or as required by applicable law (e.g., tax and accounting records under BIR rules, generally retained for at least ten (10) years). Dealer application data that does not proceed to an active account is retained for twelve (12) months before secure disposal, unless a longer period is required by law or you request earlier deletion.

Once the retention period lapses, Personal Data is disposed of or anonymized using secure methods that prevent further processing or reconstruction.

10. How We Protect Your Information

We implement reasonable and appropriate organizational, physical, and technical security measures to protect your Personal Data against accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or access, including:

  • Restricted access to Personal Data on a need-to-know basis;

  • Secure storage of physical dealer/customer records;

  • Use of reputable, secured third-party platforms for website hosting and data processing; and

  • Periodic review of our data handling practices.

No system is completely secure, and we cannot guarantee absolute security. If you have reason to believe your interaction with us is no longer secure, please contact us immediately using the details in Section 16.

11. Your Rights as a Data Subject

Under the Data Privacy Act, you have the right to:

  • Be informed that your Personal Data will be, are being, or were processed;

  • Access your Personal Data that we hold;

  • Object to the processing of your Personal Data, including processing for direct marketing;

  • Correct any inaccurate or incomplete Personal Data we hold about you;

  • Erasure or blocking of your Personal Data under certain conditions (e.g., unlawful processing, or the data is no longer necessary);

  • Data portability, i.e., to obtain a copy of your data in an electronic or structured format, where technically feasible;

  • Damages, for any harm sustained due to inaccurate, incomplete, outdated, false, unlawfully obtained, or unauthorized use of your Personal Data; and

  • File a complaint with the National Privacy Commission if you believe your rights have been violated.

To exercise any of these rights, please contact us using the details in Section 16. We may ask you to verify your identity before acting on your request, and we will respond within a reasonable time consistent with NPC guidance.

12. Marketing Communications

If you have consented to receive marketing messages (e.g., promos, new product announcements, dealer incentives) via email, SMS, or Facebook Messenger, you may opt out at any time by:

  • Clicking "unsubscribe" on marketing emails;

  • Replying "STOP" to SMS campaigns; or

  • Messaging our Facebook Page directly to request removal from promotional broadcasts.

Opting out of marketing communications will not affect transactional messages related to an existing order or dealer account.

13. Children's Privacy

macrotires.ph is intended for business and consumer audiences of legal age and is not directed at children. We do not knowingly collect Personal Data from individuals under 18 years old. If we learn that we have inadvertently collected such information, we will take steps to delete it.

14. Data Breach Notification

In the event of a personal data breach that poses a real risk of serious harm, we will notify the National Privacy Commission and affected Data Subjects within the timeframe required by the DPA (generally within 72 hours of discovery), in accordance with NPC rules on breach notification.

15. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, or legal requirements. The updated version will be posted on this page with a revised "Last Updated" date. We encourage you to review this Policy periodically.
